Construction Law

The Construction Law Department at our law firm provides consulting services and representation of clients in civil and administrative proceedings before architectural and construction administration and construction supervision authorities, as well as in proceedings before administrative courts, including the Supreme Administrative Court in the field of construction law. We offer investors assistance in carrying out the investment process, we also assist contractors and subcontractors and participants in the construction process as indicated in the Law – Construction Law.

In particular, we provide assistance in matters related to:

  • Conducting legal surveys of real estate and regulating the legal status of real estate,
  • obtaining a decision on land development conditions or compliance of the planned investment with the applicable zoning plan
  • Obtaining a decision - building permit, filing a notification of construction or construction works,
  • obtaining a decision - a demolition permit,
  • Legalization of self-construction,
  • obtaining a decision - permission to use the building,
  • A change in the use of a building object,
  • Drafting and reviewing draft contracts, including contracts related to the implementation of a joint investment, lease of real estate, right of first refusal, management of real estate, and contracts for the execution and subcontracting of construction works,
  • Supporting clients in negotiating construction contracts,
  • advising on construction and investment contracts, including those financed by public and foreign funds, and handling development projects,
  • Preparation of applications, appeals against decisions issued by first instance authorities, complaints to the Provincial Administrative Court and cassation complaints to the Supreme Administrative Court,
  • Negotiations with individuals and entities obstructing construction permits,
  • Representation in common courts in cases involving claims arising from construction contracts, concerning contractual penalties, the return of deposits securing the proper performance of the contract, and others.
